Administration charges: late fees, consent fees and Schedule 11
England and Wales · Law checked 24 October 2026 · Not legal advice
Schedule 11 to the Commonhold and Leasehold Reform Act 2002 covers administration charges: amounts for approvals under the lease (such as consent to sublet or alter), for information or documents, for late payment, or for an alleged breach of the lease.
Key rules
- A variable administration charge is payable only so far as it is reasonable (para 2).
- Demands must come with a summary of rights; you may withhold until it is supplied (para 4).
- The tribunal can decide whether a charge is payable (para 5), and can limit litigation costs charged as administration charges (para 5A).
- No administration charge is payable for collecting a peppercorn ground rent under the Ground Rent Act 2022 (para 2A).
Typical challenges
A £300 "late payment fee" for a few days' delay, or a consent fee far above the actual cost of handling the request. Ask for a breakdown and the lease clause relied on.
